====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 Heard the parties.
The petitioners seek anticipatory bail in connection with Baisi P. S. Case No. 184 of 2017 G.R. No 3329 of 2017, registered for offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioners, who are several in numbers, is of assaulting the husband of the informant with Hasua, Dabia and Kulhari, causing his death.
Patna High Court CR. MISC. No.2854 of 2019(3) dt.07-03-2019 2/3 Submission of the learned counsel for the petitioners is that nothing has been attributed against the petitioners and they have falsely been implicated in this case and there is land dispute prevailing in between the parties and the petitioners have no criminal antecedents, moreover, the petitioner No. 3 is a lady.
Heard learned A.P.P. opposes the prayer for bail stating that from the postmortem report, there are fifteen injuries found on the person of the deceased. Having heard both sides and in view of the facts and circumstances as discussed above, let the petitioner No. 3, who is a lady, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- ( Twenty five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Baisi P.S.Case No. 184 of 2017, subject to the condition that as laid down under Section 438
(2) of the Code of Criminal procedure.
So far as the case of all the petitioners is concerned, I am not inclined to grant bail to the petitioners, Accordingly,
Patna High Court CR. MISC. No.2854 of 2019(3) dt.07-03-2019 3/3 prayer of anticipatory bail is rejected.
