Mr.Satya Nand Shukla ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-01-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Chandauti P.S. Case No. 117 of 2018, registered for the offence punishable under Sections 392, 387, 341, 342, 435, 120(B) of the Indian Penal Code.

The allegation is regarding Naxals entering into the premises of the construction company of the informant and burning brand new grader of the informant worth Rs. 1 crore as also demanding ransom.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, the petitioner has not been named in the F.I.R. and his name

Patna High Court Cr.Misc. No.5297 of 2019(2) dt.30-01-2019 2/2 has transpired subsequently on the basis of his confessional statement made in one other case. The petitioner is stated to be an accused in one other case in which he is on bail. Lastly, it is submitted that similarly situated co-accused persons have already been granted bail by coordinate Benches of this Court, one of such order being dated 29.10.2018 passed in Criminal Miscellaneous No. 64731 of 2018. The petitioner is stated to be languishing in custody since 06.09.2018. Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused persons have been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Chandauti P.S. Case No. 117 of 2018.
