2. The petitioner has preferred this application for grant of regular bail in connection with Darauli P.S. Case No. 346 of 2024 dated 30.10.2024 registered for the offences punishable u/ss 191(3), 190, 103(2), 61(2)(a) of the B.N.S.

3. As per the prosecution case, the petitioner came to the house of the informant and took his father with him, when the informant went to search for him, he saw that the co-accused persons were assaulting his father with Gadasa, lathi and brick due to that his father succumbed to the injury.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.5431 of 2025(2) dt.03-03-2025 2/2 this case. There is no specific allegation against the petitioner of assaulting the deceased. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 31.10.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner took the informant's father with him thereafter he was assaulted and subsequently he died. It is a case of last seen.

6. Considering the aforesaid facts and circumstances of the case as well as the specific allegation against the petitioner, I am not inclined to enlarge the petitioner on bail.

7. The application stands rejected.
