JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is named in the first information report but informant is not an eye witness of the alleged occurrence. The informant expressed his suspicion regarding the involvement of the petitioner and some others. It is admitted case of the prosecution that one Shambhu Kumar Das, too, sustained injury in the alleged occurrence.
Learned counsel for the petitioner points out that having similar allegation, co-accused, Mukesh Ranjan Singh @
Patna High Court Cr.Misc. No.19940 of 2016 (2) dt.06-05-2016 2/2 Mukesh Kumar Singh @ Mannu @ Monno has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 21.04.2016 passed in Cr. Misc. No. 8183 of 2016 and in the aforesaid order, a Bench of this court noted down the statement of Shambhu Kumar Das, who stated before the investigating officer that some unknown persons had opened fire on him as well as deceased of the present case. No doubt, petitioner carries criminal antecedent of several cases but in the present case, except suspicion on the ground of previous enmity and threatening, there appears to be nothing against him.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 999 of 2015.
