The petitioner apprehends his arrest in connection with Thawe P.S. Case no. 185 of 2018, registered under Section 414/34 of the Indian Penal Code.
The accusation is that in course of vehicle checking, one motorcycle rider tried to flee away, but he was apprehended. The informant demanded paper regarding ownership of the motorcycle, but no paper was shown. The apprehend person disclosed his name as Shatrughan Kumar and he also disclosed that petitioner and Hemant Kumar used to commit theft of motorcycles and they hand over to him to sell the same.
Learned counsel for the petitioner submits that it
Patna High Court CR. MISC. No.8900 of 2019(3) dt.08-05-2019 2/2 would appear from the F.I.R. that petitioner is not named in the F.I.R. and his name has surfaced in the confessional statement of Shatrughan Kumar, who is said to be apprehend by the Police with stolen motorcycle. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No. 185 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
