The petitioner apprehends his arrest in connection with Jakanpur P.S. Case No. 383 of 2019 registered for the offence punishable under Sections 341/323/307/504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is allegation against the petitioner of having attacked with an iron-rod, there was no repetition of blows or any intervening circumstances so as to attract the provisions of Section 307 of the IPC. It is further submitted that there is land dispute between the parties and the informant's side was the aggressor and are agnates. It is next submitted that the petitioner is not having any criminal antecedents.

No.3753 of 2020(2) dt.21-01-2020 2/2 Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Patna, in connection with Jakanpur P.S. Case No. 383 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
