2. The petitioner seeks bail in connection with Saharsa Sadar P.S. Case No. 206/23 registered for the offence punishable under Sections 147/148/149/302/120B of the Indian Penal Code and Section 25(1-B) (a)/26/35 of the Arms Act.

3. All together six persons are named in the F.I.R. in which the petitioner is not named. The accused persons are said to have killed the deceased in the court premises. The name of the petitioner has come in the confessional statement of a coaccused in which it has been stated that he was waiting outside for taking the criminals away after the crime was committed. Charges have been framed. The petitioner is in jail since 03.04.2023 and he has clean antecedent.

Patna High Court CR. MISC. No.10105 of 2024(3) dt.16-04-2024 2/2 accused Vivek Kumar and Himanshu Kumar have been granted bail vide order dated 29.11.2023 passed in Cr. Misc. No. 56591 of 2023 and vide order dated 06.12.2023 passed in Cr. Misc. No. 77371 of 2023 respectively.

5. Considering the aforesaid circumstances, this application is allowed.

6. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Saharsa/concerned court in connection with Saharsa Sadar P.S. Case No. 206/23.

7. The petitioner will co-operate in the trial.

8. The petitioner will represent himself through his Advocate regularly in the trial. Any non-appearance will lead in the cancellation of the bail bond.
