====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 19-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Chand P.S. Case No. 146 of 2024, registered for the offences under Section 103(1) of the B.N.S.

3. As per the prosecution case, the son of the informant went outside with the petitioner in the night of 30.07.2024 and next day his dead body was recovered. The informant showed her suspicion that the petitioner killed his son.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. During course of investigation the fact came to the knowledge that the son of the informant was

Patna High Court CR. MISC. No.7359 of 2025(2) dt.19-02-2025 2/3 a drug addict and blood stained luminous substance in form of vomiting was found near the dead body of the deceased. In the post mortem report, the doctor failed to give any information about cause of death and the opinion was reserved till chemical and histopathological analysis of viscera. Except for suspicion there is nothing against the petitioner who is having antecedent of one case in which he is on bail. The petitioner is in custody since 31.07.2024. Charge sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the remoteness of allegation and further considering submission of charge sheet and period of custody of the petitioner, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Bhabua (Kaimur)/concerned court, in connection with Chand P.S. Case No. 146 of 2024, subject to the condition laid down under Section 437(3) of the code of Criminal Procedure and other following conditions: (i) One of the bailors will be a close

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
