The petitioner seeks bail in Shambhuganj P.S. Case No. 68 of 2014, registered for the offences punishable under Sections 376(2)g, 302 and other Sections of the Indian Penal Code. The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. Some of the witnesses disclosed that the daughter of the informant was found in the company with Etwari Manjhi. Etwari Manjhi disclosed in his confessional statement that he along with the petitioner Rajesh Manjhi committed rape with her. The undergarment of Pintu Manjhi was recovered from the place of occurrence but the same was not sent for chemical examination. Pintu Manjhi has already been enlarged on bail by the bench of this Court vide order passed in Cr. Misc. No. 5677/2015. The case of the petitioner stands on
Patna High Court Cr.Misc. No.32736 of 2015 (2) dt.19-08-2015 2/2 better footing, as no garment of the petitioner was recovered from the place of occurrence and except the confession of co-accused Etwari Manjhi, there is no other substantial material to show the involvement of the petitioner.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Banka, in connection with Shambhuganj P.S.
