The petitioner is languishing in custody since 2.3.2016 in connection with Durgawati P.S. Case No. 154 of 2015 for the offences instituted under Section 379 of the Indian Penal Code.

The Prosecution story, in brief, is that the motorcycle of the Informant kept inside the boundary of the house was stolen away by some unknown persons in the night.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.3.2016 and the charge sheet has been submitted in the present case. The petitioner was arrested in Dhina P.S. Case No. 73 of 2015 in which he made a confessional

In earlier case the petitioner has been granted bail. On behalf of the State it has been submitted that the petitioner is not named in the First Information Report. His name has come in course of investigation.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhabua, in connection with Durgawati P.S. Case No. 154 of 2015. (Sudhir Singh, J) S.Ali/- U T
