The petitioner seeks bail in anticipation of his arrest in connection with N.T.P.C. P.S. Case No. 15 of 2018 dated 28.02.2018 instituted for the offences under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

The petitioner has not been named in the FIR and his name has transpired only in the confession of co-accused.

It appears that while making enquiry for the purposes of giving character certificates, it was learnt that character certificates are being issued by unauthorized persons. A raid was conducted in the house of one of the accused persons from where wherewithals

Patna High Court Cr.Misc. No.5672 of 2019(2) dt.01-02-2019 2/2 for forging certificates were found. One Ram Swarup is said to have been arrested who has disclosed the complicity of the petitioner and another.

Learned counsel for the petitioner has submitted that the only evidence against the petitioner is the confession of a co-accused persons. Nothing appears to have been recovered from the possession of the petitioner.

For the aforestated facts and taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon N.T.P.C. P.S. Case No. 15 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
