The petitioner seeks modification of the order dated 19.09.2019 passed by a Bench of this Court in Cr. Misc. No. 44419 of 2019.

By the aforesaid order, the petitioner was granted anticipatory bail but subject to his surrender before the court below within a period of six weeks of the passing of the order.

The petitioner could not surrender within the stipulated period for the reason that he was away from the State of Bihar for earning his livelihood. For the reasons stated in the petition, the

Patna High Court CR. MISC. No.5950 of 2020(2) dt.02-07-2020 2/2 prayer is allowed.

The order dated 19.09.2019 is modified to the extent that if the petitioner surrenders before the court below within a period of four weeks from today, he shall be released on anticipatory bail on the same terms and conditions which were fixed on 19.09.2019.

The order stands modified to the extent indicated above.

The modification petition stands allowed and disposed off.
