Heard the learned counsel for the petitioner and learned APP for the State.
This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, registered in connection with Khagaria (Gangaur) P.S.Case No. 831 of 2021. As per FIR, five litres of country-made liquor and some articles for manufacturing the same were recovered from the joint house of the petitioner.
The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.5908 of 2022(2) dt.25-05-2022 2/2 that in one similar case the petitioner was implicated, but he is on bail. He has submitted further that the petitioner is in custody since 18.10.2021.
Considering the above facts and circumstances, let the petitioner above-named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-1st, Khagaria in connection with Khagaria (Gangaur) P.S.Case No. 831 of 2021:- Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
