JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Pakribarawan P.S. Case No. 234 of 2015 registered under Sections 25(1-B)A and 26 of the Arms Act.

The accusation is that the police, in course of investigation of Pakribarawan P.S. Case No. 233 of 2015, regarding the offence of robbery, reached in the village of petitioner then the petitioner started to flee away. On chased, petitioner was apprehended by the police and on search one country made pistol alongwith live cartridge was recovered. Thereafter the petitioner confessed his guilt about committing of robbery in connection with Pakribarawan P.S. Case No. 233 of

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and police got confessional statement of the petitioner showing the involvement in the robbery in connection with Pakribarawan P.S. Case No. 233 of 2015 except that there is nothing against him and in the present case, petitioner is in custody since 21.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Pakribarawan P.S. Case No. 234 of 2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
