JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section379 of the Indian Penal Code. On the basis of confessional statement of petitioner, the stolen motorcycle is said to have been recovered. The petitioner does have criminal antecedent of several cases. Hence, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Sonepur P.S. Case No. 346 of 2015 pending in the court of learned Chief Judicial Magistrate, Saran at Chapra stands rejected. However, the petitioner is in jail custody since 11-092015 and the present case has been lodged u/S 379 of the Indian
Patna High Court Cr.Misc. No.21484 of 2016 (2) dt.20-05-2016 2/2 Penal Code.
Therefore, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within 7 months from the date of receipt/production of copy of this order, failing which, the petitioner may renew his prayer for bail before the learned court below itself.
