JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 This is an application for grant of anticipatory bail in connection with Amarpur P.S. Case No. 298 of 2018, disclosing offences under Sections 448, 341, 323, 324, 307, 504, 337 and 34 of the Indian Penal Code.

Allegation against the petitioners is of abusing the wife of the informant and also assaulting her and when the informant came to rescue then petitioner no.5 assaulted him with iron rod on his head causing bleeding, petitioner no.1 assaulted the wife of the informant with sickle, petitioner no.4 also assaulted the wife of the informant and there is also allegation against other accused persons is of assault by bricks

Patna High Court Cr.Misc. No.4921 of 2019(2) dt.29-01-2019 2/2 and stones.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and all injuries are simple in nature cause by hard and blunt substance, which will appear from Annexure-3 series. Further, they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case No. 298 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
