The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/354/307/504 of the Indian Penal Code. Accusation is of making attempt to outrage the modesty of the informant and on alarm being raised, the daughter of the informant came to rescue whereupon she was assaulted and thrown into a well by the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
It is submitted by learned counsel for the petitioner that the informant has retracted from initial version and has filed a petition to that effect before the learned court below.
Patna High Court Cr.Misc. No.31004 of 2015 (2) dt.03-08-2015 2/2 The aforesaid facts may constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Belaganj P.S. Case No.33 of 2015, pending before the learned Chief Judicial Magistrate, Gaya.
With the above observation, this application is, accordingly, disposed off.
