JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.
The petitioner seeks bail in connection with Bihar P.S. Case No. 188 of 2014 (G. R. No. 1232 of 2014) registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
On behalf of the petitioner, it is submitted that the petitioner is not named in the first information report, during investigation, the police got recorded the confessional statement of co-accused Md. Akbar and in that confessional statement the name of the petitioner transpires. Nothing has been recovered from the possession of the petitioner. In another case i.e. Laheri P.S. Case No. 238 of 2015, the petitioner has been allowed bail, Md. Akbar
Patna High Court Cr.Misc. No.22635 of 2016 (2) dt.25-05-2016 2/2 has also been allowed bail and the petitioner is in custody since 22.02.2016 and, as such, he also deserves sympathetic consideration.
The learned APP submits that the petitioner has got criminal antecedent.
In the facts and circumstances stated above, considering that co-accused Md. Akbar has already been allowed bail and, as such, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Bihar P.S. Case No. 188 of 2014 (G. R. No. 1232 of 2014), subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail (Jitendra Mohan Sharma, J) Mishra/- U T
