2. The accused/petitioner apprehending his arrest in connection with CR Case No. 92 of 2023 registered for the offences punishable under Sections 323, 341, 498A/34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
3. The allegation is alleged to commit cruelty upon opposite party no. 2 by petitioner being husband due to non bringing of valuables of about Rs. 1 lacs on par of the materials and valuables given on the occasion of marriage of his sister-in-law by his in-laws.

It is submitted by learned counsel appearing on behalf of the petitioner that marriage of petitioner solemnized with opposite party no. 2 in year 2010 and they have two sons and one daughter out of said wedlock. It is pointed out that opposite party no. 2 forced petitioner to shift her shop from rural area to town/city of Samastipur, which upon refusal, the present false case was lodged. It is pointed out that the opposite party no. 2 left her matrimonial home out of her own and normal family disputes and differences were given a colour of cruelty through present criminal complaint case. It is pointed out that though allegation of assault is also available against brother of the petitioner but he was not made an accused, which prima facie suggest the intention of false implication of petitioner. Petitioner claimed clean antecedent.
5. Despite of service of notice, none appeared on behalf of opposite party no. 2.
6. Learned APP appearing for State submitted that the allegation is specific against petitioner, who is husband.
7. In view of aforesaid factual submissions and by taking note of fact as allegation qua demand of dowry was raised after about 13 years of marriage, which also appears very much general and omnibus allegation, accordingly, above named

No.7584 of 2025(7) dt.05-01-2026 3/3 petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Samastipur/concerned Court, where the case is pending in connection with CR Case No. 92 of 2023, subject to the conditions as laid down under Section 482(2) of the BNSS.
