JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 25(1-b)A, 27, 35 of Arms Act and Sections 16,17,18,19,20,21 and 22 of U.A.A.P. Act.

It is alleged in the FIR that raiding party on search the house of Guddu Yadav recovered one country made rifle, ten detonators, five live cartridges and two empty cartridges. On demand he did not produce any paper. Guddu Yadav disclosed the name of this petitioner and others, who had fled away. It is submitted on behalf of the petitioner that the petitioner is in custody since 21.03.2016. Charge sheet has been submitted in this case. There is no allegation of tampering of the witnesses alleged against the petitioner. The name of the petitioner

Patna High Court Cr.Misc. No.24440 of 2016 (4) dt.08-08-2016 2/2 has come on the basis of confessional statement of co-accused, who has named the petitioner. The other co-accused has been granted bail on 01.12.2015 vide Cr. Misc. No. 43956 of 2015. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in connection with Khaira P.S.Case No. 113 of 2015.
