====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 05-04-2019 Heard Mr. Safiuddin Ahmad, learned counsel for the petitioner and Sri Sanjay Kumar, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Rampur (Gaya) P.S. Case No. 394 of 2018 registered for the offence under Sections 420, 406 of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. By way of referring to F.I.R., learned counsel for the petitioner submits that it appears that in dispute relating to an offence under the provision of Negotiable Instruments Act, 1881, the informant has given a colour of criminal offence under Sections 420, 406 of the Indian Penal Code. It was alleged that the petitioner had taken loan of Rs. 7 lakh from the informant
Patna High Court CR. MISC. No.7791 of 2019(3) dt.05-04-2019 2/2 and subsequently, he issued two cheques, which as per F.I.R. have been shown to be dishonoured. However, it was submitted by learned counsel for the petitioner that bank statement shows that no such checques were ever dishonoured.
Be that as it may, considering the nature of accusation, which has been made in the F.I.R., I am of the opinion that it is a fit case for extending the privilege of anticipatory bail.
Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Ajay Kumar Paswan @ Ajay Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Rampur P.S. Case No. 394 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
