The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code, section 27 of the Arms Act, sections 4 and 40 of the Bihar Minor Mineral Concession Rules, 1972 and section 80 of the Bihar Minerals Rules, 2003. As per allegations in the F.I.R., in course of checking of a tractor with illegally loaded sand, it is stated that the driver of the tractor managed to escape. The accused persons started to assault the police personnel wherein accused Rahul Kumar and Pappu Kumar resorted to firing.
It is submitted by learned counsel for the petitioner that the allegations as levelled against the petitioner are false
Patna High Court CR. MISC. No.15808 of 2021(2) dt.12-08-2021 2/2 and concocted. Coaccused Rahul Kumar and Pappu Kumar have been enlarged on bail vide order dated 4.5.2018 (Annexure-2). The petitioner has been remained in custody since 19.6.2020 and investigation in the case has concluded.
Heard learned A.P.P. for the State. It is submitted by learned A.P.P. for the State that petitioner is accused in as many as 13 cases.
Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for more than one year, the Court directs the petitioner to be enlarged on bail in connection with Manpur P.S. Case No. 29 of 2018 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVII, Nalanda at Bihar Sharif.
