The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 342, 376, 315, 504, 506 of the Indian Penal Code.
It is alleged against the petitioner that on promise to marry, the petitioner has established physical relationship with the informant and continued for one year and when she became pregnant, this petitioner
Patna High Court CR. MISC. No.5969 of 2022(3) dt.29-08-2022 2/3 pressurized the informant to get her pregnancy aborted and when she refused to abort, she was abused and assaulted by the petitioner.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The informant is already married to one Mithilesh Kumar Yadav. The petitioner is co-villagers of the informant and she having greedy eyes over the petitioner tried to perform second marriage and when he refused to perform second marriage, this false case has been lodged.
Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer of the petitioner and submitted that there is direct allegation against the petitioner that he established physical relationship with the victim on promise of marriage. The independent witnesses have also supported the prosecution version. Considering the above-stated facts, this Court is not inclined to grant privilege of anticipatory bail to the

The prayer for anticipatory bail of the petitioner stands rejected.
