====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Section 414/34 of Indian Penal Code.

As per prosecution case, one Ranjan Kumar was caught with stolen motorcycle who disclosed that the stolen motorcycle was taken from this petitioner.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. His name transpired only on the basis of confessional statement of co-accused Ranjan Kumar. He next submits that petitioner has never sold the motorcycle in question and he has got no concern with the same. Petitioner has got clean

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nokha P. S. Case No. 173 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
