2. The petitioner is apprehending his arrest in connection with G.R. No. 2143 of 2021, arising out of Bariarpur P.S. Case No. 113 of 2021, dated 16.09.2023 for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

3. As per the prosecution case, the co-accused Umesh Kumar got appointment as a Niyojeet teacher in the year 2006 on the basis of forged mark-sheet of Intermediate under conspiracy with unknown miscreants.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. No material has come up on the

Patna High Court CR. MISC. No.12716 of 2024(4) dt.03-04-2024 2/2 record against the petitioner. The petitioner is not named in the F.I.R. rather he is a Panchayat Sachiv of Itahri Gram Panchayat. Similarly situated co-accused person has been granted regular bail by this Court vide order dated 19.04.2023 passed in Cr. Misc. No. 71066 of 2022.

5. Learned APP for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Munger in connection with G.R. No. 2143 of 2021, arising out of Bariarpur P.S. Case No. 113 of 2021, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
