The petitioner has preferred the instant application for grant of regular bail in a case registered under sections 304B, 201 and 34 of the Indian Penal Code.

As per allegations in the FIR, the sister of the informant who was married to the son of the petitioner herein was killed by the accused persons for non-fulfillment of demand of dowry.

It is submitted by learned counsel for the petitioner that the petitioner happens to be the father-in-law of the deceased. He has been falsely implicated in the case. The husband of the deceased is in custody. The petitioner is in custody since 30.8.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner being the father-in-law of the deceased and being in custody for more than 11 months, the Court directs the petitioner to be enlarged on bail in connection with Sahebganj P.S. Case no. 428 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st cum-Sub-Judge (West), Muzaffarpur.
