The petitioner is languishing in custody since 22.05.2015 in a case registered for the offences punishable under Section 409 of the Indian Penal Code.
It is alleged against the petitioner being the Panchayat Secretary has not handed over the charge of records relating to the teachers appointment for the year 2006. It is submitted by learned counsel for the petitioner that the petitioner handed over the charge of the entire records to his successor Duniyalal Paswan on 06.09.2009 and the present case has been lodged maliciously in 2015. Moreover, the
Patna High Court Cr.Misc. No.29449 of 2015 (2) dt.28-07-2015 2/2 investigation has already concluded.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakia) P.S. Case No. 115 of 2015.
