Petitioner seeks bail in a case registered under section 307 and other minor sections of the Indian Penal Code and various sections of the Arms Act.

One country made loaded katta and nine live cartridges are said to have been recovered from the conscious possession of the petitioner when he along with several other persons made firings on the police party.

Submission on behalf of the petitioner is that petitioner is in jail custody since 4.8.2015 and having more or less similar allegation some co-accused have already been granted privilege of bail. It is further submitted that so far as criminal antecedent of the petitioner is concerned, earlier four cases were lodged against the petitioner but almost all the cases had been lodged against the petitioner between

Patna High Court Cr.Misc. No.22742 of 2016 (2) dt.05-08-2016 2007 to 2010.

Considering the aforesaid facts and circumstances as well as the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Saharsa in Salkhua P.S. Case no. 164/2015.
