APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 06-02-2019 The present petition has been filed for modification of the order dated 04.01.2019 passed in Cr. Misc. No. 67272 of 2018.
2. Having heard learned counsel for the petitioner, this Court is not satisfied with the grounds on which order of the modification is required. The modification petition stands dismissed.
3. It is submitted that a submission was made by learned counsel at the time of hearing of the anticipatory bail petition that the petitioner was ready to deposit her share of the sale proceeds before the learned court below. However it is submitted that the petitioner is an aged lady without financial means to deposit the said share of sale proceeds. It is further submitted that in the alternative, the time for surrender and
Patna High Court Cr.Misc. No.5742 of 2019(2) dt.06-02-2019 2/2 furnishing of bail bond be extended.
4. Considering that the order granting bail had been passed having regard to the petitioner's expression of willingness to deposit her share of the sale proceeds, this Court is not inclined to modify the condition no. (i) for grant of anticipatory bail contemplating such deposit by her.
5. However, the period for surrender and furnishing of bail bond in paragraph-4 of the order is modified only to the extent that the period of six weeks shall be reckoned from today.
