JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-09-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 201 of the Indian Penal Code. It is a case of murder of the informant's son, namely, Md. Ismail.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and no specific allegation of committing the offence of murder is against the petitioner. There is general and omnibus allegation against him. From perusal of the postmortem report, it appears that the injury sustained by the deceased are multiple abrasions on faces and forehead. Patna High Court CR. MISC. No.5853 of 2022(3) dt.06-09-2022 2/2 was lodged against the deceased in respect of stealing the household articles and the deceased was intercepted by the villagers and recovery of ornaments and cash were made from his possession.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Jokihat P.S. Case No. 309 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
