Petitioner seeks bail in a case registered under sections 269, 270, 418, 420, 120B and section 5 of the Medical Termination of Pregnancy Act, 1971.

According to the first information report it is alleged that petitioner was running a private clinic namely Shibangi Nursing Home which was not a registered nursing home and after allurement the innocent patient carried to the said illegal nursing home for operation and to extract illegal money from the patient.

It is submitted on behalf of the petitioner that petitioner is in custody since 25.05.2015 and he has got no

It is further submitted that petitioner has been made accused in the present case due to mistake of fact and except section 420 I.P.C. all other sections are bailable. It is further submitted that petitioner is ready to deposit Rs. 20,000/- in the court below which shall be subject to the final disposal of the case.

Considering the aforesaid facts, it is directed that petitioner will deposit Rs. 20,000/- in the court below which shall be subject to the disposal of the case. The petitioner shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in Nawada Town P.S. Case No. 343 of 2015.
