The petitioner seeks regular bail in connection with Saraiya Police Station Case No. 878 of 2019, instituted for the offence under Sections 399/402/414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act.
The prosecution case as made out is that while some miscreants were planning to commit a wrong, police party reached there and seeing the police, miscreants started fleeing away. Four accused persons namely Deepak Kumar, Rajesh Kumar, Vikash Kumar @Jajveer@Kalu and Bullu Kumar @ Suraj Kumar were apprehended. Four co-accused persons have been granted bail by this Hon'ble Court vide Annexure-2 series. Learned counsel for the petitioner further submits that
Patna High Court CR. MISC. No.5939 of 2022(2) dt.09-06-2022 2/2 petitioner is in custody since 06.09.2021 and charge-sheet has been submitted. Petitioner has been made accused on the basis of confessional statement of apprehended co-accused persons. Learned A.P.P. for the State vehemently opposes the prayer for regular bail application of the petitioner. Considering the facts and circumstances of the case and 4 accused persons have been granted bail vide Annexure- 2 series while petitioner is in custody for about nine months, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV (West), Muzaffarpur, in connection with Saraiya Police Station Case No. 878 of 2019.
