Heard learned counsels for the petitioner and the State.

This is an application for bail in a case of misuse. The petitioner was accused in a case registered for the offences punishable under Sections 147, 148, 149, 307, 332, 333, 337, 342, 353, 379, 440 of the Indian Penal Code, 27 of the Arms Act and 3⁄4 of the Explosive Substances Act, The petitioner was initially granted bail.

The case was instituted in 1999 and the petitioner was absconding for twelve years and has surrendered on 21.12.2012.

It appears from the impugned order that the

Patna High Court Cr.Misc. No.33557 of 2014 (3) dt.30-01-2015 2 / 2 charge was framed only on 15.03.2014. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc Additional Sessions Judge-Vth, Saran at Chapra, in connection with Sessions Trial No. 527 of 2013, arising out of Bhagwan Bazar P.S. Case No. 164 of 1999.

Learned court below will be liberty to cancel the bail bond of the petitioner if he defaults for two consecutive occasions.
