The petitioner apprehends his arrest in Guraru P.S. Case No. 124 of 2022 registered for the offences punishable under Sections 341, 354(B), 504, 323 and 34 of the Indian Penal Code pending in the Court of learned J.M. 1st Class, Gaya. As per the prosecution case, the petitioner along with other accused persons caught hold of the informant and pulled her when she was returning from her tuition to her home.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that neither any
Patna High Court CR. MISC. No.7626 of 2023(3) dt.19-06-2023 2/2 cloth nor any incriminating article has been recovered by the police from the place of alleged occurrence. The petitioner has no criminal antecedent as mentioned in para-3 of the bail application.
Learned APP for the State opposes the bail petition and submits that the statement of the victim has been recorded under Section 164 of the Cr.P.C., in which she has supported the prosecution case.
Considering the facts and circumstances of case and the statement of the victim under Section 164 of the Cr.P.C., I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected.
