JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected vide order dated 19.3.2014 passed in Cr. Misc. No. 22406 of 2013 directing the trial court to expedite the trial of the petitioner but the trial court has reported that out of nine proposed prosecution witnesses, only two proposed prosecution witnesses could be examined . Learned counsel appearing for the petitioner submits that general allegation of firing has been made against the petitioner and several other F.I.R named accused and moreover, the informant is not an eye witness of the alleged occurrence. It is further contended by him that having more or less similar allegation one co-accused namely, Indal Yadav has already been

Patna High Court Cr.Misc. No.36423 of 2015 (3) dt.30-11-2015 2/2 granted privilege of bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner does not have any criminal antecedent and there is no possibility of conclusion of trial of petitioner in near future, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge-V, Barh in connection with Session trial no. 355 of 2014 arising out of Bakhtiyarpur P.S.Case No. 316 of 2012 (Hemant Kumar Srivastava, J) N.K/- U T
