2. The petitioner seeks bail in connection with Rupau P.S. Case No. 17 of 2024 registered for the offence punishable under Sections 376(D) of the Indian Penal Code and Sections 4 and 6 of the POCSO Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have committed rape on the minor daughter of the informant one after another.

4. The petitioner is in custody since 31.03.2024.

5. Considering the fact that the petitioner is accused of gang rape against the minor daughter of the informant and

6. Accordingly, the application stands dismissed.

7. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
