The petitioner is accused in connection with Bibhutipur P.S. Case No. 60 of 2003, registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the prayer for bail of the petitioner was rejected on 18.03.2015 vide Criminal Miscellaneous No. 49284 of 2014 with direction to expedite the trial within a period of one year, if the trial is not concluded within the aforesaid period, the petitioner may renew his prayer his prayer for bail. while more than one year has been elapsed, but the case is still pending for prosecution evidence. The petitioner is in custody since 22.12.2012. Having regard to the facts and the circumstances of

No.19054 of 2016 (2) dt.04-05-2016 2/2 the case and in view of the order passed on 18.03.2015 vide Criminal Miscellaneous No. 49284 of 2014, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge, Rosera in connection with Bibhutipur P.S. Case No. 60 of 2003 (S.T. No. 338 of 2014).
