The petitioner is languishing in custody since 23.03.2015 in a case registered for the offences punishable under Sections 379/461/411 of the Indian Penal Code. The accusation is of committing theft in the cloth shop of the informant. The petitioner was identified while fleeing away from the place of occurrence. Subsequently, 13 Sarees and 5 Gamchha (Towel) were recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that the articles seized were of day today use and they have not been put on TIP. A statement has been made in para 3 of

Patna High Court Cr.Misc. No.24932 of 2015 (02) dt.29-06-2015 2/2 the petition that the petitioner has no criminal antecedent and the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Birpur in connection with Raghopur P.S. Case No. 44 of 2015. (Dinesh Kumar Singh, J) DKS/- U T
