Mr.Sharda Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-02-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Special Case No. 9582/2018, arising out of Gardanibagh P.S. Case No. 453/2018, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner has submitted that police has registered two cases against the petitioner for the occurrence as alleged in the written report. The petitioner was arrested in Gardanibagh P.S. Cse No. 452/2018 for offences under Sections 25(1-b)a, 26 and 35 of Arms Act. Thereafter he has been remanded in this case, which has been lodged on the same day.

Patna High Court Cr.Misc. No.5220 of 2019(2 ) dt.05-02-2019 2/2 It is alleged in the written report that two cane of Tobago strong beer each containing 500ml has been recovered from possession of this petitioner.

Petitioner is in custody since 15.11.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 9582/2018, arising out of Gardanibagh P.S. Case No. 453/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
