The petitioners are apprehending their arrest in connection with Hajipur Sadar P.S. Case No. 662 of 2019 for the offence under Sections 147, 148, 149, 447, 341, 323, 325, 302, 504, 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that allegation against the petitioners is that the petitioners and others have assaulted the deceased with rod, butt of rifle and pistol. He further submits that from the post-mortem report, it appears that there was no external injury on the deceased, which means that the aforesaid weapons were not used. He further submits that the incident took place on 17.08.2019 whereas the F.I.R. was lodged on 10.10.2019 i.e. after one month and 23 days of the occurrence.

No.5288 of 2020(3) dt.29-06-2020 2/2 Considering the aforesaid, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Hajipur (Vaishali) in connection with Hajipur Sadar P.S. Case No. 662 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the further condition that on release the petitioners will render their services as volunteer for a period of one month in dedicated Covid Hospital. They are required to report to the District Nodal Officer in the concerned region, who shall utilize their services in this pandemic. (Anil Kumar Upadhyay, J) uday/- U T
