JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-02-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Vishnupad P.S. Case No. 120 of 2020, registered for the offenses punishable under Sections 414/34 of the Indian Penal Code. As per FIR, the police got information that five accused persons were present near Ghugditad bypass with two stolen motorcycles. When the police reached there they became to flee away but two accused persons Deepak Kumar and Naveen Kumar got apprehended. Two motorcycles were recovered and seizure list was prepared in the presence of entire witnesses. Learned counsel for the petitioner has submitted that in
Patna High Court CR. MISC. No.15109 of 2021(3) dt.28-02-2022 2/2 entire case diary there in nothing against the present petitioner except the confessional statement of co-accused Deepak Kumar and Naveen Kumar who were arrested at the spot.
The case diary was called for and as per paragraph No. 14 of the case diary there is no criminal antecedent against the present petitioner.
Considering the above-mentioned, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Vishnupad P.S. Case No. 120 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
