JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks bail in connection with Ujjiyarpur P.S. Case No. 270 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act. There is recovery of 5187.72 litres of liquor from the truck and petitioner was arrested there.

Submission of learned counsel for the petitioner is that he is only driver and he is in custody since 14.11.2019, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for bail stating that huge quantity of liquor has been recovered. In view of above facts and circumstances, I am not inclined to grant bail to the petitioner. However, if the trial is not concluded within a period of six months, petitioner may renew his prayer for bail.
