1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Bhore P.S. Case no. 444 of 2023 registered under sections 457 and 380 of the Indian Penal Code.

3. As per the prosecution case, the informant states that gold ornaments, money etc. details of which has been given in the F.I.R was stolen from his house. He suspects the hands of the four named accused persons mentioned herein.

4. Learned counsel for the petitioner submits that the F.I.R was registered against unknown. Referring to the order of the learned trial Court it is submitted that the name of the petitioner transpired in the confessional statement of co-accused Arjun Baitha and Anil Yadav. The F.I.R named co-accused namely Dhanu Kumar Ram, Vikash Kumar Yadav and Arjun

Patna High Court CR. MISC. No.7039 of 2024(2) dt.17-02-2024 2/2 Baitha have been enlarged on bail vide order dated 10.1.2024 passed in Cr. Misc. no. 83038 of 2023. So far as the alleged recovery of Rs. 5,000/- is concerned, the same is an amount which is available in every other household . The petitioner is in custody since 7.9.2023 and has no criminal antecedent. Chargesheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R, the name of the petitioner having transpired in the confessional statement of co-accused, grant of bail to the F.I.R named co-accused as stated here-in-above, the petitioner being in custody for more than 5 months since 7.9.2023 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Bhore P.S. Case no. 444 of 2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj.
