JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-02-2015 Heard learned counsels for the petitioners and the State. The petitioners being parents, brother's wife and cousin of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant after five years of marriage for non fulfillment of dowry demands.
It is submitted by learned counsel for the petitioners that the accusation is not specific against the petitioners and for the occurrence of 15.3.2014, the FIR has been registered on
Patna High Court Cr.Misc. No.30521 of 2014 (3) dt.10-02-2015 2/2 19.3.2014. It is claimed by the petitioner that the informant participated in the cremation and subsequently decided to lodge the case.
Considering the thrust of accusation against the husband of the victim, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Hathauri P.S. Case No. 31 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
