The deceased's elder sister claimed to have seen the petitioner taking away the deceased towards a mango tree but she does not say, who pressed the neck of the deceased. In course of investigation, it came to light that the deceased and petitioner were on talking term.
The contention on behalf of the petitioner is that according to prosecution case itself, at the time of alleged occurrence, one unknown person and one FIR named accused were also present there and, therefore, it cannot be said, who killed the deceased.
Patna High Court Cr.Misc. No.30286 of 2015 (3) dt.02-11-2015 Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sasaram (Darigaon) P.S.
