Patna High Court MJC No.537 of 2017 dt.22-12-2017 2/2 appended with the show cause affidavit as Annexure-D that the petitioner did not come at the time of measurement, however, measurement has been taken and some deviation has been found and the builder has been noticed with regard to that.
Thus, in my view, this contempt proceeding cannot continue further and is, accordingly dropped. However, the petitioner if so advised, would be at liberty to assail Annexure-D to the show cause affidavit before a competent forum.
