The petitioner is languishing in custody since 22.01.2016 in connection with Baniyapur P.S. Case No. 238 of 2015 for the offences instituted under Sections 147, 148, 149, 307 and 302 of the IPC and 27 of the Arms Act.

It is alleged by the informant that on 21.10.2015, his father went to visit Drama on the eve of Dashhara festival. Several villagers were also watching the same. In the meanwhile, this petitioner, Ashok Rai, Bittu Kumar came and started quarreling with one Rohit Kumar then Vikarma Rai resolved the problem. After sometime, the petitioner alongwith FIR named accused persons came at the P.O. and petitioner made discriminate firing

Patna High Court Cr.Misc. No.20821 of 2016 (7) dt.18-10-2016 2/2 upon the father of the informant as a result of which he sustained injury on the left side of his neck. Co-accused Raja Rai made discriminate firing upon Sandeep Kumar Singh for which he sustained injury on his left hand. The informant's father was brought to hospital where he died.

A report was called for from the court below regarding the stage of the case vide order dated 15.09.2016. The same is at Flag-'C'. It has been reported that the case is at the stage of 313 Cr. P.C. and within a month the trial is going to be concluded. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. The same is rejected in Baniyapur P.S. Case No. 238 of 2015, pending in the court of the learned C.J.M., Saran at Chapra. The court below is directed to ensure that the trial be concluded within a period of two months from the date of receipt/production of copy of the order.
