The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 498A, 504 and 506/34 of the Indian Penal Code and Sections 3/ 4 of the D.P. Act.

It is a case of cruelty due to non-fulfilment of dowry demand of Rs.2,00,000/-.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He

No.3955 of 2020(6) dt.11-05-2022 2/2 further submits that Opposite Party No.2 has solemnized second marriage on 15.06.2020 as stated by the petitioner in his supplementary affidavit vide para-3 of the petition and a certified copy issued by Mukhiya, Raghopur East Panchayat is annexed as Annexure-3 to the supplementary affidavit. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Barh in connection with Complaint Case No. 242(C) of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
