JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 370, 370-A, 372, 373, 120B of the Indian Penal Code , Sections 4, 5 of Immoral Traffic Act and Section 6 of POCSO Act.
The first information report reflects that it were own relatives of the informant who pushed her into trade of flesh and thereafter, they got solemnized her marriage with co-accused Md. Rafique but the aforesaid co-accused Md. Rafique subsequently sold the informant to petitioners who also pushed her into trade of flesh but when the informant became ill, the
Patna High Court CR. MISC. No.3996 of 2019(3) dt.29-03-2019 2/2 petitioners brought her to her house but petitioners were apprehended by the villagers.
Submission on behalf of the petitioners is that petitioners have committed no offence and as a matter of fact, they brought the informant to her home but they were apprehended by the villagers on mere suspicion. Moreover, petitioners are in jail custody since 28.09.2018 and they do not have any criminal antecedent.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj Mahila P.S. Case No. 62 of 2018.
