JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2020 Learned counsel for the petitioners seeks permission to withdraw the instant bail petition in respect of petitioner no.2 Priya Ranjan Kumar @ Rajeev Kuamr, who has been arrested during pendency of the bail petition.

Prayer is allowed.

The pre arrest bail petition is dismissed as withdrawn in respect of petitioner no 2.

Heard learned counsel for the petitioner no.1 as well as learned counsel for the State.

Petitioner no.1 apprehends arrest in a case registered for the offences punishable under Sections 379/120B and other allied sections of the Indian Penal Code and under sections 30, 37 and other allied sections of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner no.1 submits that the petitioner has falsely been implicated in this case. Nothing incriminating has been recovered from the house

Considering the facts of the case, let the petitioner no.1, above named, in the event of arrest/surrender within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Nawada, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
